Client recovers almost £15,000 after trip in warehouse

Our first success story starts in late 2018, when our client was walking towards the exit of her workplace for lunch when she tripped on a piece of wood that was protruding from a broken pallet.

She instinctively put out her right arm and upon impact with the floor immediately felt pain in her right shoulder. The discomfort left her unable to carry out her job as she faced several months of uncertainty. She eventually had to find alternative employment.

When the client came to us, we worked to firstly force an admission of liability from the employer’s insurer. We then obtained expert medical legal evidence that attributed 12-18 months of symptoms to the accident.

With the help of our expertise and support, she secured compensation for the pain and suffering caused by the injury and for her other losses including the earnings she lost after she was unable to return to her role.

£10,000 settlement after fall from folding step

Our client was working as part of a warehouse team unloading boxes of crystal from a container.

He was given a folding step to carry out the task of reaching and removing boxes from the top of high stacks within the container.

The tightly-packed boxes were difficult for the Claimant to pull out and required some force to remove even as he was stretching to reach the highest boxes. On releasing a box, our client slipped off the step as he turned round. He fell, crashing down onto his right arm and shoulder.

Liability was not initially admitted on submission of the Claim. However, proceedings were issued and we continued to fight our client’s case that the equipment provided was not suitable for the job.

We obtained expert medical reports and arranged the necessary scans; the Claimant’s symptoms were attributed to the accident for a period of 6-12 months. We negotiated a £10,000 settlement for the client to cover his injuries and other losses including loss of earnings.

If you’ve had an accident at work, you should get in touch with our specialist team as soon as possible.  We’ll take the details we need and explain the next steps. We always recommend you take the following steps, but don’t worry if there’s something here you haven’t done:

  • Complete an accident report and inform your Health and Safety representative at work
  • If you are still in pain, shock, or distress when the report is completed, do not sign it.
  • Keep details of anyone who witnessed the accident.
  • If possible, as soon as you can, ask your Health and Safety representative to take photos of the scene and make them available to you.
  • Write down your recollection of exactly what happened in the accident, including the location and approximate time.
